License agreement between artists and PLAKATIV.STORE GmbH

1. License Grant

By submitting works, the artist (hereinafter "Artist") grants PLAKATIV.STORE GmbH (hereinafter "PLAKATIV.STORE") a non-exclusive right to use and commercially market the submitted works ("Works") for an unlimited period of time and worldwide under the following conditions:

1.1. Right to store the works in our offline and online art archive.

1.2. Right to prepare and cut the works for poster and book printing.

1.3. Right to create advertising materials from the works for the website www.plakativ.store and other partner companies of PLAKATIV.STORE.

1.4. Right to publish the above-mentioned advertising content on the PLAKATIV.STORE website as well as on paid and unpaid advertising channels, including but not limited to social media platforms.

1.5. Right to sell the works via PLAKATIV.STORE channels.

2. Revenue sharing

The artist receives a revenue share of 15% of the net turnover, which is defined as income from the sale of the works, less shipping costs and any other costs directly related to the sale (e.g. material costs for printing or production costs), including VAT.

3. Payments

PLAKATIV.STORE undertakes to pay the artist's share of the sales no later than the 15th of the month following the end of the three-month billing period. Payment is made via bank transfer, PayPal or TWINT payment. The minimum payment amount is CHF 50.

The artist has the right to withdraw his works at any time and to terminate the collaboration in writing. The works will be removed from the database within 30 days of receipt of the termination and will not be marketed any further. The usage rights for advertisements already produced or articles already published remain in place, but no new advertising content will be created using the artist's works.
PLAKATIV.STORE reserves the right to remove artists and their works from the platform at any time and without giving reasons.

5. Warranties and Liability

The artist assures that he/she is the author of the submitted works and has all necessary consents and permissions for elements used in the works. PLAKATIV.STORE assumes no liability for the submitted works. The artist retains the right to continue to sell the submitted works himself or with other partners, in any medium and on any market of his/her choosing.

6. Place of jurisdiction

This contract is governed by Swiss law and the place of jurisdiction is the registered office of PLAKATIV.STORE in Baar, Canton Zug, Switzerland.
